The consistory, dated January 26, 2012, received the Office of Administrative Court No. 5 of Murcia, which certifies in the judgment dismissing the complaint filed by the PSOE councilors for alleged violation of fundamental rights in the exercise of his office regarding the request for access to information from different administrative records at City Hall
The spokesperson for the Popular de Puerto Lumbreras, Dolores Arenas, has urged the Socialist Party of Puerto Lumbreras to "change their strategy of false allegations and accusations against the current government of the Popular Party in the city and use their efforts to work on positive for Puerto Lumbreras. "
Arenas reiterates this request to the Socialists lumbrerenses after being in the City Council Office of Court Administration N º 5 of Murcia dated January 26, 2012, which refers the certification of the judgment by dismissing the administrative appeal brought by councilors of the Municipal Group Socialist against the City Puerto Lumbreras Puerto Lumbreras, for an alleged violation of fundamental rights in the exercise of his office regarding the request for access to information from different administrative records at City Hall.
In this sense, Arenas explained that "the Socialist Party of Puerto Lumbreras is continuing its strategy based on the filing of appeals without legal basis to discredit the government team of the council with the dirty style of 'anything goes'."
So, Arenas called "stop and false allegations and accusations that are filing from the Popular Party government came to town in 2003."
Thus, the Office of Administrative Litigation Court No. 5 of Murcia has submitted to City Council certification of final judgment dismissing the action brought by the Socialist councilors for alleged violation of fundamental rights in the exercise of his office , regarding the request for access to information from various administrative files.
This statement indicates that "through the disputed decree is not being infringed the fundamental right to invoke, not restrict, or their right to information, an unfounded nor documentation."
In this sense, Arenas, reiterates that the government team available to all councilors seeking information, always with a policy of "openness, transparency and honesty to the public, unlike other times."
Complaints dismissed and filed
The People's spokesperson, Dolores Arenas, recalled that "since 2003, courts have been closed or have not attended a number of complaints filed by the Socialist Party."
Arenas allegations as "are filed by the PSOE in Puerto Lumbreras for the sole purpose of harming the City Council, and members of his government team."
As concrete examples, the Administrative Board of the High Court of Justice declared the appeal inadmissible brought by the Socialist councilors on February 6, 2009 to challenge the collaboration agreement between the Autonomous Community and City Hall.
The appeal was brought by the PSOE councilors against the agreement formalized by the Autonomous Community, through the Ministry of Social Policy, Women and Migration, and the Municipality of Puerto Lumbreras, to regulate the granting of subsidy to the financing of project to build the Day Care Center of Puerto Lumbreras.

In addition, the Administrative Court No. 2 of Murcia issued an order on February 4, 2010 with which rejected the administrative appeal brought by councilors of the Municipal Group Socialist Puerto Lumbreras against the City for an alleged violation of fundamental rights in the his tenure, in relation to the request for access to information from different administrative records at City Hall.

Finally, among the various complaints filed or dismissed, the Administrative Court No. 3 of Murcia issued June 15, 2011 an Order agreeing to the expiration of the administrative record on appeal by the Socialist councilors against the liquidation of general budget for 2009.
On December 23, 2011 the Court issued the firmness of aging and terminating the proceedings, and the return of the administrative record, not to file suit had been announced.

In conclusion, Arenas said that "such allegations reveal the misconduct and seriousness of the Municipal Socialist Group and its unique and dastardly strategy based on false allegations and accusations which are intended only entangle and harm" .
