In compliance with the Supreme Court decision recognizing the right of the Community of Irrigators of Puerto Lumbreras (Murcia) that is resolved, explicitly, the application of that water transfer
The Ministry of Agriculture, Food and Environment has agreed to submit to public information the transfer of a maximum annual volume of one cubic hectometres of water from the river basin of the Guadalquivir Segura, through Negratín- Almanzora (Andalucia) connection .
The Ministry has taken this decision in accordance with Article 15 of Law 10/2001 of 5 July, the National Hydrological Plan, in Article 36 of Law 21/2013, of December 9, Evaluation environmental, and in Article 86 of Law 30/1992 on the Legal Regime of Public Administrations and Common Administrative Procedure.
Thus, all stakeholders will have 30 days to review the documents associated with the transfer and, if they so choose, make such allegations deemed appropriate.
Article 14 of Law 10/2001 of 5 July, the National Hydrological Plan provides for approved for transferring small amounts between different territorial areas of water planning, always respecting the principle of ensuring current and future demands all use and exploitation of the donor basin.
The Ministry has taken this decision in compliance with the Supreme Court decision recognizing the right of the Community of Irrigators of Puerto Lumbreras (Murcia) that is resolved, expressly, in the application claiming the aforementioned water transfer.
A volume aimed at alleviating the implementation deficit in agricultural demand unit 63, "Aquifer Alto Guadalentín" link referred to in the hydrological plan of the Segura River Basin.
The amount transferred can only consolidate the supply of equipment of the existing irrigation systems, which are in a precarious situation, both in situations of underfunding, for lack of sufficient collateral, and provided they are conducting a sound management and efficient water.
The Segura basin, once positively resolve the environmental processing of transfer guarantee instruction in the procedure of granting concessions associated with this transfer, compliance with the principles of advertising and processing competing preferred on equal conditions, those projects that are inconsistent with the rational use of water and better protection of their environment.
